These Terms and Conditions regulate the use of the website Benty.es, as well as the purchase of gift vouchers and products offered through it. By accessing and using this site, the user accepts the conditions set out herein.

1. Purpose of the contract
Benty.es is an online platform dedicated to the sale of sports and leisure-related experiences and products. Customers can purchase gift vouchers that entitle them to enjoy experiences provided by independent suppliers. The role of Benty.es is limited to the intermediation in the sale and issuance of such vouchers and it is not directly responsible for the provision of the experiences.

2. Purchase and validity of vouchers
The purchase of a gift voucher on Benty.es entitles the customer to redeem it for the specified experience. Vouchers are valid for six months from the date of purchase, unless otherwise stated in the offer. Each voucher may only be used once and cannot be exchanged for cash. The transfer of the voucher to another person is not possible, unless the “send as a gift” option has been selected (in which case the voucher is issued directly to a specific recipient).

3. Provision of experiences
The performance of the experiences is the sole responsibility of the associated suppliers. The customer must first contact Benty to arrange the date and conditions of use, always subject to availability. Benty will then connect the customer with the final provider. Benty.es accepts no liability for modifications, cancellations, quality or safety of the experience, except where legally required as an intermediary. Any claims relating to the provision of the experience must be addressed directly to the provider.

4. Right of withdrawal
In accordance with applicable EU consumer law, the customer has the right to withdraw from the contract within fourteen calendar days from the date of purchase, without giving any reason. 5. Prices and payment conditions
The prices published on Benty.es include applicable taxes, in particular the IGIC in the Canary Islands. Payment for vouchers or products is made through the secure payment methods available on the platform. The purchase will only be confirmed once full payment has been received.

6. Shipping, returns and exchanges
Products purchased on Benty.es are shipped via the official postal service. Two shipping options are available:

• Standard shipping, delivered to the address indicated by the customer.
• Gift shipping, which includes special packaging intended for third parties.

Delivery times are approximate and will be indicated during the purchase process. Benty.es is not responsible for delays attributable to the postal service.

For returns, the customer has fourteen calendar days from receipt of the product to exercise the right of withdrawal, provided that the product is in perfect condition and unused. Exclusions from the right of withdrawal
For health protection and hygiene reasons, swimwear, underwear and similar products cannot be returned or exchanged once unsealed after delivery or if they show signs of use. The right of withdrawal may only be exercised for these products if they are returned in their original condition, unused and with the hygiene seal intact.

Product exchanges
If the product received shows manufacturing defects, damage during transport or an incorrect size, the customer may request an exchange. The request must be made within seven calendar days of receipt of the order by writing to office [at] benty [dot] es and indicating the order number. Benty.es will cover shipping costs in cases of company error or defective products. In all other cases, exchange shipping costs will be borne by the customer.

7. Liability
Benty.es guarantees the correct issuance of the purchased voucher and the access to the necessary data for its redemption. However, responsibility for the execution, safety and quality of the experience lies exclusively with the supplier. Benty.es shall not be liable for any damages arising from the use or enjoyment of the experience, except in cases provided by applicable law.

8. Data protection
The personal data provided by customers will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish data protection regulations. Information regarding the processing, purposes and user rights is available in the Benty.es Privacy Policy.

9. Applicable law and jurisdiction
These Terms and Conditions are governed by Spanish and European law. For the resolution of any disputes arising from their interpretation or execution, the parties submit to the competent Courts and Tribunals of Las Palmas de Gran Canaria, unless consumer protection legislation establishes another mandatory jurisdiction.
